Terms of Service

You may use the Service only if you are 18 or older and legally able to enter into a contract.

Paid contests are additionally limited to players physically located in Wisconsin at the time of entry. Free practice play may be available more broadly.

We verify age and location. Providing false information, or masking your location through a VPN, proxy, emulator, or spoofing tool, is a material breach of these Terms.

• One account per person. Accounts are personal and non-transferable.
• You must register with accurate information in your own legal name.
• You are responsible for everything that happens under your account, and for keeping your credentials secure.
• Tell us immediately at [SUPPORT EMAIL] if you suspect unauthorized access.
• We may require identity verification at any time, and must do so before processing withdrawals.

We may refuse, suspend, or close an account that violates these Terms, that we reasonably believe is engaged in fraud or abuse, or that we are required to close by law.

IQnack contests are contests of skill. Every player in a contest receives identical content under identical conditions and time limits, and outcomes are determined by accuracy and speed of play. Nothing in the scoring is randomized, and no purchase improves a player's chance of winning.

Full contest mechanics, scoring, and tie-breaking are in our Official Contest Rules, which are incorporated into these Terms.

• KIQ cannot be purchased with money. It is earned through play and in-app bonuses only.
• KIQ has no cash value. It cannot be redeemed for cash, transferred between accounts, sold, or exchanged for cash prizes.
• KIQ is a limited, revocable licence to use a feature of the Service. It is not your property.
• We may adjust, expire, or discontinue KIQ, including on account closure, without compensation.

Some cosmetic items, such as themes, may be purchased. These purchases are final and non-refundable except where required by law. Cosmetic items confer no competitive advantage of any kind and do not affect contest outcomes.

You must not:

• Use bots, scripts, automation, macros, emulators, or modified clients;
• Use a second device, another person, or any outside reference during a contest;
• Record, capture, or share contest content;
• Operate multiple accounts or collude with other players;
• Exploit a bug rather than reporting it;
• Interfere with the integrity, security, or operation of the Service.

Violations may result in voided results, forfeiture of entry fees and prizes, withheld balances, and permanent account closure.

The Service, including all questions, boards, software, design, and branding, is owned by KNACKZENT LLC or its licensors. You receive a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose.

You may not copy, scrape, reproduce, distribute, reverse engineer, or create derivative works from any part of the Service.

You are solely responsible for taxes on prizes. If your net winnings meet the applicable reporting threshold in a calendar year, we may be required to issue a Form 1099 and will request the information needed to do so. We may withhold withdrawal until that information is provided.

We provide tools to help you play within your limits, described at Responsible Play, including self-exclusion. If you request self-exclusion, we will close your access to paid contests for the period you request and will not knowingly reopen it early.

We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service. If we discontinue the Service entirely, we will give reasonable notice and provide a means to withdraw remaining cash balances.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, that content will be free of defects, or that contests will be uninterrupted.

To the fullest extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the greater of (a) the amount you deposited in the 6 months before the claim arose, or (b) $100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunity.

Some jurisdictions do not allow certain limitations; where that applies, these limits apply to the fullest extent permitted.

You agree to indemnify and hold harmless KNACKZENT LLC and its members, officers, and agents from any claim arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

Informal resolution first. Contact [SUPPORT EMAIL] with the details. Most matters resolve here. Neither party may begin formal proceedings until 30 days after written notice of the dispute.

Governing law. These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules.

Venue. Any dispute not resolved informally shall be brought in the state or federal courts located in Outagamie County, Wisconsin, and both parties consent to that jurisdiction.

You may close your account at any time by contacting support. We will return any withdrawable cash balance subject to verification.

We may suspend or terminate your account for breach of these Terms, suspected fraud, or where required by law. On termination for cause, entry fees for contests in progress and any prizes derived from the violating conduct may be forfeited. Any legitimate remaining cash balance will be returned subject to verification.

We may update these Terms. Material changes will be notified in the App or by email at least [14/30] days before taking effect. Continued use after the effective date is acceptance. If you do not accept, close your account and withdraw your balance.

Apple Inc. and Google LLC are not parties to these Terms, are not sponsors of any contest, and have no responsibility for the Service or any contest. Any claim relating to the Service is against KNACKZENT LLC only.

These Terms, together with the Official Contest Rules and Privacy Policy, are the entire agreement between us. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
